Johnson & Johnson Paid $68 Million to Settle Ortho Evra Lawsuits

October 10, 2008—Johnson & Johnson has paid at least $68.7 million to settle lawsuits filed by hundreds of women who suffered blood clots, heart attacks or strokes after using the Ortho Evra birth control patch.

Complaints filed against Johnson & Johnson allege the company hid or altered data about the risks of high levels of estrogen released by the patch. The company has avoided trial by entering into confidential settlement agreements with injured victims.

FDA Launches Ortho Evra Patch Probe

 

March 2, 2006—The FDA announced that it is launching a safety review of Ortho Evra birth control patches, following evidence that the patch is associated with increased side effects. The agency previously warned women in November 2005 that Ortho Evra was linked with higher incidences of blood clots.

Evidence indicates women using the patch are exposed to approximately 60 percent more estrogen than those women using traditional birth control pills.

The review is part of a larger probe to assess the safety of various patches. The agency is concerned that defects in the patches may lead to increased absorption rates, causing too much medication to be delivered to the patient.

FDA Warns Women About Risks of Ortho Evra Birth Control Patch

November 10, 2005—The FDA warned that women using the Ortho Evra birth control patch were at a higher risk for blood clots. The agency announced that the labeling on the medication will be updated to reflect this latest warning.

The warning noted that women using the patch are exposed to about 60 percent more estrogen than with a typical birth control pill. Higher doses of estrogen can lead to a higher risk of experiencing side effects.

Ortho Evra Lawsuit

July 25, 2005—Ten women filed a lawsuit against Johnson & Johnson and its subsidiary, Ortho McNeil, alleging the Ortho Evra patch caused them to suffer strokes and blood clots. The lawsuit calls the product "unreasonably dangerous" and contends the patch is "defectively designed."

The FDA still has not taken action to protect women from these potentially serious side effects. In fact, the agency initially approved the patch in spite of evidence that Ortho Evra greatly increased the risk of strokes and blood clots.

The FDA has come under fire lately for not responding adequately to public health concerns, including its delayed response with the prescription drug Vioxx.
